一、課程內容
本課程內容是對於選定近年來刑事法判決之實體法上的問題進行批判式的討論，目的在使同學對於刑事實體法基本概念之理解有實證檢驗的機會，特別是希望藉此能讓同學能夠看到學說與實務之間一些認識上與態度上的落差。選課同學二人一組，必須對所指定之實務判決在排定日期提出一小時的報告，報告概要內容最慢必須在報告日前三天傳送給其他同學，報告日報告後接受問題詢問並進行討論。期末繳交含註腳約五千字之完整報告。本學期所選擇的判決將於學期初發給選課同學。本課程為討論課程，故不接受旁聽。

Syllabus

The goal of this course is to critically discuss issues in criminal law appeared in selected criminal court judgments. It is intended to give students an opportunity to examine the uses of basic concepts in criminal substantive law in real cases, and particularly, to observe epistemological and attitudinal differences between theory and practice. Each student who plans to take this course shall team up with another one. Each team shall make one-hour oral presentation on the scheduled date. Three days before the presentation, each team shall give the outline of the presentation to other students in class. Right after its presentation, each team shall answer questions from their classmates and the instructor, and participate in the class discussion. In the end of the semester, each team shall submit a formal written paper (a minimum of 5000 characters is required, including the footnotes). The criminal court judgments this class selects will be assigned to students in the beginning of the semester. Since this is a discussion class, auditors will not be permitted.

The grading depends on students’ performances in their oral presentations and written papers (60%). The remaining 40 percent will be evaluated from students’ performances in the class discussion.
